This Privacy Policy explains how BG STRATEGIES LLC, doing business as MotionGuard (“MotionGuard,” “we,” “us,” or “our”) collects, uses, shares, and protects your information when you interact with us — including our advertisements, advertorial articles, landing pages, sales pages, order forms, checkout, post-purchase offers, email and text messages, customer support, and the website www.trymotionguard.com and any related sites we operate (collectively, the “Services”).

By accessing or using the Services, placing an order, or providing us with information, you acknowledge that you have read and understood this Privacy Policy. If you do not agree, please do not use the Services.

1. Scope & Who This Policy Applies To

This Privacy Policy applies to every stage of your interaction with MotionGuard, including but not limited to:

  • Advertisements you see or click on third-party platforms such as Facebook, Instagram, TikTok, YouTube, Google, Pinterest, Snapchat, and similar networks;
  • Advertorial articles, landing pages, and pre-sell pages — including article-style or editorial-style content that is, in fact, paid advertising;
  • Product sales pages, order pages, and checkout;
  • Post-purchase pages and one-click upsell or cross-sell offers presented after an order;
  • Email, SMS/text messages, and other marketing or transactional communications;
  • Customer service interactions, reviews, surveys, and questionnaires; and
  • Any other website, page, or service that links to this Privacy Policy.

This policy does not cover the practices of third parties we do not own or control. See Section 16.

2. Information We Collect

We collect information in three ways: information you give us directly, information collected automatically as you use the Services, and information we receive from third parties.

2.1 Information you provide directly

When you place an order, create an account, accept an upsell offer, subscribe to messages, contact support, leave a review, or complete a survey or quiz, we may collect:

  • Contact & identity data — name, email address, phone number, and shipping and billing addresses;
  • Order & transaction data — products purchased, order value, the offer or bundle selected, upsells accepted or declined, discount codes used, and order history;
  • Payment information — payment card or payment-method details are collected and processed by our PCI-compliant payment processors (see Section 8). We do not store full payment card numbers on our own systems;
  • Communications — the content of emails, text messages, chat messages, support tickets, social media messages, reviews, and survey or questionnaire responses you send us; and
  • Optional information you choose to share — for example, comments about your comfort, fit, activity level, or general wellness goals that you voluntarily include in a review, survey, or support message.

A note on health-related information. MotionGuard sells a general-wellness comfort and support product. We do not require, and we ask you not to send us, sensitive medical or diagnostic information. If you voluntarily share health-related details (for example, in a review or support message), we use that information only to respond to you and improve our Services, and we treat it with care. MotionGuard products are not intended to diagnose, treat, cure, or prevent any disease, and nothing in our Services is medical advice. See our Terms of Service.

2.2 Information collected automatically

When you view an ad, open an advertorial, browse a landing or sales page, or move through checkout and post-purchase pages, we and our service providers automatically collect:

  • Device & technical data — IP address, device type, operating system, browser type and language, and screen settings;
  • Usage & clickstream data — pages and advertorials viewed, links and buttons clicked, time spent, scroll depth, the page you came from and go to next, and how you move through the funnel;
  • Advertising & campaign data — the ad or campaign that referred you, referring URLs, and tracking parameters such as UTM tags and click identifiers (for example, fbclid, gclid, and ttclid) that connect your ad click to your later activity, including any purchase; and
  • Cookie & pixel data — identifiers placed by cookies, pixels, tags, and similar technologies described in Section 3 and our Cookie Policy.

2.3 Information we receive from third parties

We may receive information about you from:

  • Advertising and analytics platforms — aggregated or hashed data about ad performance, conversions, and audiences;
  • Payment processors and fraud-prevention providers — transaction status, verification results, and fraud or chargeback signals;
  • Shipping and fulfillment partners — delivery and tracking updates;
  • E-commerce, review, and marketing platforms we use to operate the Services; and
  • Data partners who help us verify addresses, reduce fraud, or supplement contact information, where permitted by law.

3. Cookies, Pixels, and Tracking Technologies

We and our partners use cookies, web beacons, pixels, tags, SDKs, server-side conversion tracking, and similar technologies across our ads, advertorials, landing pages, sales pages, checkout, and post-purchase pages. These technologies let us recognize your browser or device and follow your activity through the funnel — for example, connecting the ad you clicked to the advertorial you read, the sales page you viewed, and the order and upsells you completed. 3.1 Types of technologies we use

  • Strictly necessary — required for core functions such as loading pages, maintaining your cart, and completing checkout securely.
  • Performance & analytics — help us understand how people find and use the Services so we can improve them.
  • Advertising & retargeting — help us measure ad performance, attribute conversions, build audiences, and show you relevant ads on other sites and apps.

3.2 Third-party advertising and analytics partners

Depending on the campaign and page, these may include, among others: Meta (Facebook/Instagram Pixel and Conversions API); Google (Google Analytics, Google Ads, and related tags); TikTok (TikTok Pixel and Events API); other ad networks such as Pinterest, Snapchat, and Microsoft/Bing; analytics and session-measurement tools; and our page builder and e-commerce platform. Some partners use server-side tracking (a “Conversions API”), which sends conversion and event data — including hashed identifiers such as email or phone — directly from our servers to the partner to measure ad results.

3.3 Your choices

You can manage cookies through your browser settings and, where available, through our cookie banner or preference tool. You can opt out of certain interest-based advertising through industry tools such as the Digital Advertising Alliance (optout.aboutads.info), the Network Advertising Initiative (optout.networkadvertising.org), and, in the EU/UK, youronlinechoices.eu. Blocking some technologies may affect how the Services work. See also Section 11.

4. How We Use Your Information

We use the information we collect to:

  • Process, fulfill, ship, and confirm your orders, including any post-purchase upsell or cross-sell offers you accept;
  • Process payments, prevent and detect fraud, and manage returns, refunds, and chargebacks;
  • Provide customer support and respond to your questions, reviews, and requests;
  • Send transactional messages (order confirmations, shipping updates, and account notices);
  • Send marketing communications by email and, with your consent, by SMS/text message;
  • Operate, measure, and optimize our ads, advertorials, and landing and sales pages, including attributing conversions and testing different versions of pages and offers;
  • Build and target advertising audiences, including custom audiences, lookalike/similar audiences, and retargeting audiences on third-party platforms;
  • Personalize content, offers, and recommendations;
  • Analyze and improve the Services and our products;
  • Comply with legal obligations and enforce our terms, policies, and agreements; and
  • Protect the rights, safety, and property of MotionGuard, our customers, and others.

5. Advertorials and Editorial-Style Advertising

Some of our marketing content is presented in an article, story, listicle, review, or editorial-style format. This content is advertising. Pages labeled or styled as articles, “advertorials,” or similar are paid promotional content created by or on behalf of MotionGuard, not independent news, journalism, or consumer-protection reporting.

Where these pages feature individuals, names, photos, or images, they may include paid endorsers, spokespeople, illustrative examples, or models, and any depiction is for illustration. Individual results vary. These advertorial and landing pages use the same cookies, pixels, and tracking technologies described in Section 3, and information collected on them is handled as described in this Privacy Policy.

6. Post-Purchase and One-Click Upsells

After you complete an order, we may present additional offers (upsells, downsells, or cross-sells) on post-purchase pages. To make these offers convenient, accepting one may add the item to your order using the payment, billing, and shipping information you provided at checkout — sometimes with a single click and without re-entering your payment details.

When you accept a post-purchase offer, we and our upsell-software providers and payment processors process the additional transaction using that stored information. Each accepted offer is a separate charge, and the price, terms, and any shipping for each offer are shown on the offer page before you confirm. Declining an offer does not affect your original order. 7. Email and SMS/Text Message Marketing

7.1 Email

If you place an order or sign up, we may send you marketing emails about products, offers, and content. You can unsubscribe at any time using the link in any marketing email or by contacting us. You will still receive transactional emails related to your orders.

7.2 SMS/text messages

If you provide your mobile number and agree to receive text messages — for example, by checking an SMS consent box or texting a keyword — we may send you marketing and transactional texts. Key points:

  • Consent is not a condition of purchase. You can buy from us without agreeing to marketing texts.
  • Message frequency varies. Message and data rates may apply, depending on your mobile carrier and plan.
  • Opt out anytime by replying STOP to any marketing text. Reply HELP for help. Carriers are not liable for delayed or undelivered messages.
  • We do not sell or share mobile phone numbers collected for SMS with third parties for their own marketing purposes.

8. How We Share and Disclose Information

We do not sell your information for money in the traditional sense. We do share information in the following ways:

  • Service providers / processors who perform services for us under contract, including: payment processing; order management and our e-commerce platform; page-building software; shipping and fulfillment; warehousing; post-purchase upsell software; email and SMS marketing platforms; customer-support and helpdesk tools; review platforms; fraud-prevention; and analytics providers.
  • Advertising and analytics partners — we share certain online identifiers, cookie/pixel data, and conversion or event data (including hashed contact information) with platforms such as Meta, Google, and TikTok to measure ads, attribute conversions, and build and target audiences. Depending on your jurisdiction, this may be considered a “sale” or “sharing” of personal information — see Section 9.
  • Corporate transactions — in connection with a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, your information may be transferred as part of that transaction.
  • Legal and safety reasons — to comply with applicable law, legal process, or government requests; to enforce our terms and policies; and to detect, prevent, or address fraud, security, or technical issues, or to protect the rights, property, or safety of MotionGuard, our customers, or others.
  • With your direction or consent — for any other purpose disclosed to you at the time we collect the information.

9. “Selling” and “Sharing” of Personal Information & Targeted Advertising

Certain U.S. state privacy laws define “sale” and “sharing” (or “targeted advertising”) very broadly. Because we use advertising cookies, pixels, and conversion tracking that disclose online identifiers and activity to advertising partners, our use of these technologies may be considered a “sale” or “sharing” of personal information, or processing for targeted advertising, under laws such as the California Consumer Privacy Act as amended (CCPA/CPRA) and similar laws in other states.

The categories of personal information that may be “sold” or “shared” in this sense are online identifiers, device and usage/clickstream data, and inferences drawn for advertising. We do not knowingly sell or share the personal information of consumers under 16 years of age. You can opt out of this activity — see Section 11.

10. Your Privacy Rights

Depending on where you live, you may have some or all of the following rights regarding your personal information:

  • Right to know / access the categories and specific pieces of personal information we have collected about you;
  • Right to delete personal information we hold about you, subject to legal exceptions;
  • Right to correct inaccurate personal information;
  • Right to data portability — receive a copy of certain information in a portable format;
  • Right to opt out of the “sale” or “sharing” of your personal information and of targeted advertising;
  • Right to limit the use of certain sensitive personal information, where applicable;
  • Right to non-discrimination — we will not discriminate against you for exercising your rights; and
  • Right to appeal — in some states, if we deny your request, you may appeal that decision.

These rights are provided to residents of states with applicable privacy laws, including, for example, California, Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, and others as such laws take effect. The rights available to you depend on your state of residence and applicable law.

10.1 How to exercise your rights

To make a request, contact us using the details in Section 18. We will take reasonable steps to verify your identity before responding, and we will respond within the timeframe required by applicable law. You may use an authorized agent to submit a request on your behalf where the law allows; we may require proof of the agent's authorization.

10.2 California “Shine the Light”

California residents may request information about disclosures of personal information to third parties for their direct marketing purposes. To make such a request, contact us as described below.

11. Do Not Sell or Share My Personal Information

You have the right to opt out of the “sale” or “sharing” of your personal information and of targeted/interest-based advertising. You can do this by:

  • Using our cookie banner or preference tool to decline advertising/targeting cookies;
  • Submitting a request to us using the contact details in Section 18 (or via a “Do Not Sell or Share My Personal Information” link, if provided on our site); and/or
  • Enabling an opt-out preference signal such as Global Privacy Control (GPC) in a supported browser or extension. Where required by law, we treat a recognized GPC signal as a valid request to opt out of sale/sharing for that browser or device.

Because opt-outs are often tied to a specific browser, device, or cookie, you may need to opt out again if you clear cookies, use a different browser, or use a different device.

12. International Users (EU/UK and Others)

We operate from the United States, and your information may be processed in the United States or other countries that may have different data protection laws than your own. If you are in the European Economic Area, the United Kingdom, or another region with data protection laws:

  • Legal bases. We process your information to perform our contract with you (for example, to fulfill orders), based on your consent (for example, marketing messages and certain cookies), to comply with legal obligations, and for our legitimate interests (for example, to operate, secure, and improve the Services and our advertising).
  • Your rights. You may have rights to access, correct, delete, restrict, or object to processing, to data portability, and to withdraw consent. You may also have the right to lodge a complaint with your local supervisory authority.
  • Transfers. Where we transfer information internationally, we use appropriate safeguards required by applicable law.

13. Data Retention

We keep personal information for as long as needed to provide the Services and for the purposes described in this policy — including to fulfill orders, provide support, maintain records of transactions, comply with legal, tax, accounting, and recordkeeping obligations, resolve disputes, prevent fraud, and enforce our agreements. When information is no longer needed, we take reasonable steps to delete, anonymize, or de-identify it.

14. Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information, and we rely on PCI-compliant payment processors for payment data. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for keeping any account credentials confidential.

15. Children's Privacy

The Services are intended for adults and are not directed to children. We do not knowingly collect personal information from children under 13 (or under 16 where applicable). If you believe a child has provided us with personal information, please contact us and we will take appropriate steps to delete it.

16. Third-Party Links and Services

Our ads, advertorials, and pages may link to or be displayed on third-party websites, platforms, and apps that we do not control. This Privacy Policy does not apply to those third parties, and we are not responsible for their privacy practices. We encourage you to review the privacy policies of any third-party site or service you visit.

17. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we do, we will revise the “Last updated” date above and, where required by law, provide additional notice. Your continued use of the Services after an update means you accept the revised policy.
